TERMS & CONDITIONS

The following is a summary of the most important points of the terms and conditions of the membership agreement, which you are considering entering into.

You can change your mind about being a member even after you have made your application. You will lose that right either seven days after making the application or the first time that you or any linked member enters the studios to use the facilities, whichever happens first. You will then be bound by the full terms and conditions before you make the application.

Membership, fees and fee increases
Your membership is calculated in whole calendar months. You can pay monthly either by Autopay or the total amount due in a one off payment.

If you pay monthly, we will take the Autopay payment on the same date each month according to when you joined. Each of these payments covers that month’s membership.

If you pay 6 monthly or yearly, the payment covers the following 6 or 12 months membership respectively, but your membership will not end automatically after that initial period. It will only end if you give us notice – as explained in ‘Length of Membership’, otherwise you will continue to pay for the month’s you continue to be a member.

Our fees and charges are subject to VAT at the prevailing rate. If the VAT rate is increased at any time during your membership, including the Initial Term we reserve the right to increase our rates in accordance with the new VAT rate.

If you fall behind with your membership payments for more than 30 days, we will charge you an administration fee of £50. We may also suspend your or any linked members access rights to our facilities.

Ending your Membership
You can end your membership only by giving us one month’s payment notice. We require notice in writing or email and we will then confirm the date of your last payment. Stopping paying your fees is not the same as notice. If you stop paying, but do not give us notice, you will continue to have to pay the fees.

Giving us notice means writing to us or sending us an email telling us you wish to end your membership.  We will confirm when your membership will end and until your membership has ended you must continue to pay your fees.

Length of Memberships

Upfront Memberships
You are committed to the duration of your Upfront membership. This means that you cannot be refunded if you end your membership earlier than the 6 or 12 month period you have signed up to, except in circumstances listed under ‘Ending your Membership Early’. Once your initial period is completed, you are able to give us one month’s notice at any time.

Flexible Membership
This membership is indefinite until you give us one month’s notice, either in writing or via email.

Bookings and Cancellations
You may only book or reschedule classes for yourself.
You will be charged a penalty fee for a class where cancellation or the rescheduling of a class is not made with reasonable notice.  For example, enough time to allow someone else to have the booking.
PAYU members who fail to give 24 hours to cancel a class will forfeit the class credit as if attended.
Classes are booked on a first come, first served basis. Should a member join the waiting list for a particular class and then book that class, their booking will be subject to the terms and conditions in the usual way.
PAYU packs and Taster passes are non-refundable. The PAYU are valid for three months from date of purchase and the Taster Pass is valid for 1 month.

Ending your membership early
You can end your membership at any time in the following circumstances:
• You suffer a medical condition that prevents you from  using our facilities.
• You lose your employment.
• You relocate to more than 10 miles further from the club.
• You can provide sufficient evidence that you have had a significant change in personal circumstances, which means it is no longer viable for you to use our facilities or         to continue being a member.

In any of these cases, you can end your membership by giving us notice and relevant proof  – we will then cancel your membership immediately.

Our right to cancel your membership
We can cancel your membership if:
•    You or your guests use rude or abusive language.
•    You or your guests uses or threatens to use violent or aggressive behavior.
•    You repeatedly break the terms and conditions.
•    You allow another person to use your membership card.
•    We believe your continued membership is not in the interest of other members.

If we do cancel your membership, we will refund any unused months of your fees, less any reasonable costs we have had to pay in connection with the incident.
 
Suspending your membership
You may suspend your membership for any reason. You will be debited £5 per month unless it is for medical reasons.

Liability
We are only liable for damage or loss to property or for death or injury when we have been negligent or have failed to take reasonable care.
